WAIVER/ RELEASE OF CLAIMS FOR ILLNESS OR DEATH
By signing this document, you waive, release and assume the risk of claims for serious illness and death, including any claims arising from exposure to the COVID- 19 virus in connection with MOYSC activities. Please read it carefully before signing it.
VOLUNTARY PARTICIPATION: This document relates to activities sponsored by the Manchacha Optimist Youth Sports Complex (“MOYSC”). Any participation in these activities is voluntary on the part of those who participate in them.
RISK OF EXPOSURE: While the MOYSC endeavors to reduce the risks, individuals who enter on MOYSC premises or participate in MOYSC sponsored activities may be exposed to infectious bacteria, viruses, or other pathogens, including MRSA, influenza, and the COVID-19 virus.
ASSUMPTION OF RISK: By signing this document, you knowingly and freely assume all risks of injury, illness, or death, either known or unknown, that may result from exposure to any disease-causing agent (including the COVID-19 virus) either on the premises of MOYSC or in connection with any activity sponsored by MOYSC. The risks you assume include any that may arise from the negligence of the parties released by this Waiver and Release.
RELEASE OF CLAIMS: On behalf of himself or herself, and his or her heirs, assigns, and personal representatives, the individual signing this document HEREBY RELEASES AND HOLDS HARMLESS the MANCHACHA OPTIMIST YOUTH SPORTS COMPLEX, its directors, officers, agents, employees, volunteers, sponsors, advertisers, and any other person or entity against whom a claim might be asserted because of its association with the MOYSC for any claim for any illness, disability, medical expense, or death resulting from exposure to any disease causing agent (including the COVID-19 virus) either on the premises of MOYSC or in connection with any activity sponsored by the MOYSC. This release includes any claims that may arise from the negligence of the parties released by this Waiver and Release.
WAIVER ON BEHALF OF MINOR CHILD
WARRANTY OF REPRESENTATION: The individual signing this waiver warrants that he or she is the parent or guardian of the child named below and has authority to bind him or her.
WARRANTY OF CHILD’S UNDERSTANDING: The individual signing this waiver warrants that he or she has explained the importance of this Waiver and Release to the named child and has explained to him or her (a) the risk of being exposed to disease-causing agents in connection with MOYSC activities, and (b) the importance of the child’s adhering to the rules and regulations of MOYSC designed to reduce the risk of infection from possible exposure to disease causing agents. The individual signing this waiver warrants that the named child understands and accepts these risks and responsibilities.
RELEASE OF CLAIMS ON BEHALF OF MINOR CHILD: The individual signing this waiver agrees that the Waiver and Release set forth above extends to any claims that may be asserted by or on behalf of the child named below and that he or she fully waives and releases any claims covered by the Waiver and Release that might be asserted by or on behalf of the named child whether by him or her, by his or her spouse, or otherwise by any representative of the child.
